Google hustles Android 4.2.1 onto Nexus devices to give you December back
With the rollout of a major OS upgrade like Android 4.2, we can imagine it's easy to forget something, but Google's omission of the entire month of December in the People app was certainly a doozy. The beauty of the Nexus program is that Google can rectify little issues like that post-haste, however, and Mountain View has now rolled out Jelly Bean 4.2.1, a small update that adds back that all-too-important month. So far, Nexus 4 and 10 users have reported getting the update, according to XDA Developers, though there's no evidence yet of any other fixes. Check your Nexus device (or the source) to see if it's arrived in time for, you know.
Update: Looks as if the Nexus 7 is a go, too!

Trial to start for teenager who shot baby in East Palo Alto | Mike ...
The trial is scheduled to begin today for the teenager accused of killing a 3-month-old boy in East Palo Alto last year while shooting into a car occupied by the child?s family.
Fabian Zaragoza of East Palo Alto and another unidentified teen allegedly mistook a member of the family ? who had been leaving a baby shower at the time of the June 5, 2011, incident ? for a Sure?o gang member, according to prosecutors.
Police said two teens fired 15 bullets into the family?s vehicle as they were leaving the party on Wisteria Drive around 1 a.m., injuring both parents and killing the infant boy, Izack Jimenez Garcia.
The baby?s brother, then 4, was not harmed. A day after the shooting, grief-stricken mother Ivonne Garcia-Lopez, who was shot in the leg while in the back seat, blamed herself for not being able to shield her youngest child.
On the night of the shooting, according to police, Zaragoza was seeking vengeance on Sure?o members who had beaten him up a week earlier in Redwood City. He thought he saw two of the gang members on Wisteria Drive, near the home where the baby shower was being held, police said. He allegedly left to fetch a gun and returned to the street with an accomplice.
The two teens thought at least one of the Sure?os were in the car when they opened fire into it, police said.
Izack Garcia was shot in the head, and his father, who was driving, was hit in the shoulder. Garcia-Lopez said she threw herself over her 4-year-old and hoped that the car seat would protect her 3-month-old.
?I took him out of the car seat and he had a hole in his head,? the devastated mom said at a news conference held a day after the incident.
Zaragoza, who was 17 at the time of the shooting but is being tried as an adult, has pleaded not guilty and remains in custody on no-bail status. Today, the first steps of his trial will begin more than a year after he was indicted by a grand jury on murder charges.
Trial motions are expected to be completed soon and a jury will likely be selected before the new year, San Mateo County District Attorney Steve Wagstaffe said Monday. Opening statements will be in early January, he said.
However, Zaragoza?s attorney, Peter Goldscheider, said Monday that he doesn?t believe a jury will be finalized until after the holidays.
Goldscheider declined to comment on the case before a jury is selected. He has said in the past that the evidence does not prove Zaragoza was the shooter.
Police say Zaragoza made statements implicating himself in the crime, and that the murder weapon was found in his home.

LG 'Optimus G2' rumored for May launch with 1080p screen
LG's Optimus G isn't even available in some countries yet, but already it seems a successor could be in the works. Reports from Korea's MK Business News suggests that the "Optimus G2" (said to be a provisional name) could be scheduled for launch as early as next May. Key upgrades are said to include a a 5-inch, 1080p display, up from the 4.7-inch 1280x768 panel in the original, and a 2GHz quad-core Qualcomm CPU. LG will reportedly pit the G2 against the successor to Samsung's Galaxy S3.
But here's the kicker -- the article also claims the "Optimus G2" will come with Android "Key Lime Pie" on-board. KLP is the widely-expected codename for the next major iteration of Android, presumably either version 4.3 or 5.0. We'd be very (very) surprised to see a fresh version of Android so quickly after 4.2, especially considering the short interval between the two flavors of Jelly Bean.
Nevertheless, as a Nexus partner, LG would have privileged access to code ahead of time, which might help it get devices running newer versions of Android to market more rapidly than other OEMs. Stranger things have happened, but we're still inclined to take this part of the story with a large pinch of salt.
The 5-inch screen size and 1080p resolution look set to become the new standard for high-end phones in 2013. HTC has already launched the Droid DNA on Verizon in the states, while Sony's next high-end device, "Yuga," is rumored to sport a similar display. Likewise, Samsung is rumored to be hard at work on a 4.99-inch 1080p SuperAMOLED panel for use in future phones.
Whatever form it takes, the Optimus G's successor will find itself among plenty of competition.

Italy votes in center-left primary amid recession
ROME (AP) ? Italians voted in a primary for a center-left candidate to run in spring general elections that will in large part determine how Italy's tries to fix its troubled finances and emerge from a grinding recession.
Exit polls and preliminary results cited late Sunday by Italian media indicated that none of the five candidates won a 50 percent majority, meaning a runoff will be held Dec. 2 between the top two finishers: Pier Luigi Bersani, the 61-year-old leader of the main center-left Democratic Party, and Matteo Renzi, the 37-year-old mayor of Florence.
Some analysts had predicted a low turnout, thanks to a series of party finance scandals that have soured Italians on their political class. But some voting stations stayed open well beyond the official closing time to allow everyone on line to cast their ballots, the ANSA news agency reported.
While the candidates have been gamely campaigning and debating one another ahead of the primary, Sunday's vote has largely been overshadowed by speculation about the political ambitions of Italy's current premier, Mario Monti, and whether ex-Premier Silvio Berlusconi will run for office for a fourth term.
Berlusconi again threw a wrench in the primary plans of his center-right People of Freedom party by hinting Saturday that he was "thinking" about returning to politics. Berlusconi has flip-flopped several times on the question in recent weeks, complicating efforts by his party secretary, Angelino Alfano, to rally support behind a party that has been tainted by the finance scandals in recent months.
"If Berlusconi really does return to the field as he has said, I have to ask myself what's the point of having a primary, which only has sense if he doesn't run," Alfano said. "Otherwise we have to rethink everything."
Berlusconi resigned as premier last year amid personal sex scandals and legal woes, unable to convince international markets that he could balance Italy's budget and pass necessary financial reforms to save Italy from a Greek-style debt crisis. Italy's president tapped Monti, a respected economist and former European commissioner, to head a government of technocrats to guide Italy until general elections.
Monti's government has imposed a painful austerity program and pushed through structural reforms that together have succeeded in bringing down Italy's borrowing costs. While ordinary Italians have chafed at the reforms, the positive market reaction to Monti's stewardship has fueled support for a second term, particularly among centrist politicians and some of Italy's business elite.
Monti has ruled out running for premier but has left the door open for a second term if no party wins a clear majority and he is tapped to head another government.
"I will reflect on all the possibilities ? none excluded ? in which I could possibly be able to contribute to the best interests of Italy and Europe," Monti said on a primetime talk show on RAI state television Sunday.
President Giorgio Napolitano made clear last week that Monti couldn't run for office heading a party ticket, since he's currently a senator-for-life. Newspaper analysts suggested Napolitano's aim in keeping Monti out of the campaign, on a potentially unelectable centrist ticket, was to ensure he remained a viable alternative for premier if neither of Italy's main parties wins a clear majority ? or to be named his successor as president.

Professor finds profiling in ads for personal data website
LAS VEGAS (Reuters) - Dr. Latisha Smith, an expert in decompression sicknesses afflicting deep sea divers, has cleared criminal background checks throughout her medical career. Yet someone searching the Web for the Washington State physician might well come across an Internet ad suggesting she may have an arrest record.
"Latisha Smith, arrested?" reads one such advertisement.
Another says: "Latisha Smith Truth... Check Latisha Smith's Arrests."
Instantcheckmate.com, which labels itself the "Internet's leading authority on background checks," placed both ads. A statistical analysis of the company's advertising has found it has disproportionately used ad copy including the word "arrested" for black-identifying names, even when a person has no arrest record.
Latanya Sweeney is a Harvard University professor of government with a doctorate in computer science. After learning that her own name had popped up in an "arrested?" ad when a colleague was searching for one of her academic publications, she ran more than 120,000 searches for names primarily given to either black or white children, testing ads delivered for 2,400 real names 50 times each. (The author of this story is a Harvard University fellow collaborating with Professor Sweeney on a book about the business of personal data.)
Ebony Jefferson, for example, often turns up an instantcheckmate.com ad reading: "Ebony Jefferson, arrested?" but an ad triggered by a search for Emily Jefferson would read: "We found Emily Jefferson." Searches for randomly chosen black-identifying names such as Deshawn Williams, Latisha Smith or Latanya Smith often produced the "arrested?" headline or ad text with the word "arrest," whereas other less ethnic-sounding first names matched with the same surnames typically did not.
"As an African-American, I'm used to profiling like that," said Dr. Smith. "I think it's horrendous that they get away with it."
Instantcheckmate.com declined to comment. The company's founder and managing partner, Kristian Kibak, did not respond to repeated emails and phone calls over a period of several months, and other employees referred calls to management. Company officials also declined to comment when visited twice at their call center in Las Vegas. Former employees said they had signed nondisclosure agreements that barred them from speaking openly about Instant Checkmate.
Instantcheckmate.com is one of many data brokers that use and sell data for a variety of purposes. The field is attracting growing attention, both from government and consumers concerned about possible abuse. Rapid advances in technology have opened up all sorts of opportunities for commercialization of data.
Anyone can set up shop and sell arrest records as long as they stay clear of U.S. legal limitations such as using the information to determine creditworthiness, insurance or job suitability.
Companies that compete with instantcheckmate.com include intelius.com and mylife.com. An examination of Internet advertising starting last March as well as Sweeney's study did not find any rival companies advertising background searches on individual names along racial lines.
WHO CAN BE TRUSTED?
In its own marketing, Instantcheckmate.com sums up its mission like this: "Parents will no longer need to wonder about whether their neighbors, friends, home day care providers, a former spouse's new love interest or preschool providers can be trusted to care for their children responsibly."
According to preliminary findings of Professor Sweeney's research, searches of names assigned primarily to black babies, such as Tyrone, Darnell, Ebony and Latisha, generated "arrest" in the instantcheckmate.com ad copy between 75 percent and 96 percent of the time. Names assigned at birth primarily to whites, such as Geoffrey, Brett, Kristen and Anne, led to more neutral copy, with the word "arrest" appearing between zero and 9 percent of the time.
A few names fell outside of these patterns: Brad, a name predominantly given to white babies, produced an ad with the word "arrest" 62 percent to 65 percent of the time. Sweeney found that ads appear regardless of whether the name has an arrest record attached to it.
Blacks make up about 13 percent of the U.S. population but account for 28 percent of the arrests listed on the FBI's most recent annual crime statistics.
Internet advertising based on millions of name pairs has only existed in recent years, so targeting ads along racial lines raises new legal questions. Experts say the Federal Trade Commission, which this year assessed an $800,000 penalty against personal data site Spokeo.com for different reasons (related to the use of data for job-vetting purposes), would be the institution best placed to review Instant Checkmate's practices.
The FTC enforces regulations against unfair or deceptive business practices. A deceptive claim that would be more likely to get people to purchase a product than they would otherwise would be a typical reason the FTC might act against a company, said one FTC official who did not want to be identified. For example, authorities could take action against a firm that makes misleading claims suggesting a product such as records exist when they do not.
"It's disturbing," Julie Brill, an FTC commissioner, said of Instant Checkmate's advertising. "I don't know if it's illegal ... It's something that we'd need to study to see if any enforcement action is needed."
Instant Checkmate's Kibak, who is in his late 20s, works out of a San Diego office near the Pacific Ocean. The son of a California biology professor, he did not respond to repeated phone calls and emails seeking comment about his business.
"We would consider the answers to most of your questions trade secrets and therefore would not be comfortable disclosing that information," Joey Rocco, Kibak's partner according to the firm's Nevada state registration, said in an email.
Instant Checkmate LLC maintains its official corporate headquarters at an address in an industrial zone across the highway from the Las Vegas strip. At the back of a long parking lot, the company shares a warehouse building with an auto repair shop. At one end, a large roll-up garage-style door opens to the company's call center. Workers face a gray cinder-block wall, their backs to the entrance. Staff declined to answer questions.
DATA FIRMS PROLIFERATE
Professor Sweeney's analysis found that some instantcheckmate.com ads hint at arrest records when the firm's database has no record of any arrest for that name, as is the case with her own name. In other cases, such as that of Latisha Smith, the company does have arrest records for some people by that name, although not for the doctor of hypobaric medicine in Washington State.
Laura Beatty, an Internet Marketing Inc expert in helping companies achieve prominent placement in Web searches, said instantcheckmate.com appeared to choose its ads based on combinations of thousands of different first and last names and then segment them based on the first names.
"There does look like there is some definite profiling going on here," she said. "In the searches that I looked at, it seemed like the more Midwestern- and WASP-sounding the name was, the less likely it was to have either any advertisement at all or to have something that was more geared around the arrest or criminal background."
Internet firms selling criminal records and personal data to the public have proliferated in recent years, as low-cost computing enables even modest operations to maintain large databases on millions of Americans. Such sites sell access to users for a one-time fee - $29.95 in the case of instantcheckmate.com - or via monthly subscription plans.
Instant Checkmate, first registered in Nevada in 2010, said in a recent press release posted online that the firm had attracted more than 570,000 customers since its start and counted more than 200,000 subscribers.
According to alexa.com, an Amazon.Com Inc site analyzing website traffic, instantcheckmate.com has ranged roughly between the 500th and 600th most visited U.S. site in recent weeks, making it an increasingly major player in this area.
The company is able to target its ads on an individual name basis through a program called Google AdWords. Instantcheckmate.com and others companies like it use Google AdWords to bid to place small text advertisements alongside search results on major websites triggered by the names in their data base. Such ads typically cost a company far less than a dollar, sometimes just a few pennies, each time they're clicked.
Google says it does not control what names appear in AdWords. "Advertisers select all of their keywords, and ads are triggered when someone searches for that name. We don't have any role in the advertiser's selection of unique proper names," said a Google spokesman.
Some in Congress have raised concerns about developments in the use of personal data. In October, Senator John Rockefeller IV, a Democrat from West Virginia and chairman of the Senate Committee on Commerce, Science and Transportation, opened a probe into leading data brokers. "Collecting, storing and selling information about Americans raises all types of questions that require careful scrutiny," he said.

Improbable Fiction at Theatre 3. A review | The RiotACT
Last night GoosePig and I fronted up to Theatre 3 to see the opening night of Canberra Rep?s latest outing, Alan Ayckbourn?s Improbable Fiction.
The theatre was filled to capacity, the set was jaw-droppingly good, and then the bad news.
One of the lead characters, Brevis, had been replaced at short notice for health reasons.
An already tricky play robbed of impetus while last minute replacement Andrew Kay struggled stoically through having to read his lines.
The performance wasn?t helped by asking six Canberra actors to try and pull off the same English regional accent.
The play could easily have been transplanted to the likes of Bowral or Moss Vale without losing anything.
But instead the accents alone took us on a journey from France to Wales with occasional diversions to Pakistan.
And then there was the first act where GoosePig was blessed by sleep while your correspondent slogged manfully on.
The whole of the first part was devoted to an unlikeable meeting of a mostly unlikeable writers? group.
Sure it set the characters up, but they were pretty crude stereotypes.
The butch lesbian, the fragile beaten wife, the nerd with poor social skills, the eager to please larger lady, the ageing technical writer caring for his dying mother, the beautiful young woman improbably impressed by writers, the ill-tempered misogynist curmudgeon.
There, done, pieces on the board. Didn?t need an hour did it?
It seems it did.
The second act was a mashup of three short mystery stories aping the styles of the bad writers introduced in the first act.
The humour is therefore largely derived from laughing at the poor writing. A joke that wore thin for this reviewer as the play dragged on into the third hour.
If you?re a fan of mystery stories (your correspondent is not) then it could well be your cup of tea.
As it was the second act was where my own eyes got heavy.
It did however, give the actors lots of scope to chew up the scenery and stride the boards.
Having said that, as Andrew Kay gets up to speed with the crucial role of Brevis I can imagine the work really picking up some oomph.
So maybe wait a little later in the run before giving it a go.
Improbable Fiction is running at Theatre 3 until 8 December 2012.

2 dead in violence at South Africa gold mine
JOHANNESBURG (AP) ? A South African gold mining company says two of its workers have been killed and another injured in violence at one of its mines as unrest continues in the industry.
Harmony Gold Mining Co. Ltd. said Friday that the attack happened late Thursday at its Kusasalethu mine near Carletonville, about 80 kilometers (50 miles) southwest of Johannesburg. Harmony said production at the mine had not been affected by the attack. The company said police had begun an investigation.
The killings come after weeks of labor unrest at mines across South Africa, one of the nation's biggest economic engines. Violence during strikes at Lonmin PLC's platinum mine near Marikana led to the deaths of 46 people, including 34 miners who were shot dead by police.

Not unlike Tammany Hall in New York, the Sena promoted the interests of local Maharashtrians or ?sons of the soil? against the influx of migrant workers to Mumbai, historically India?s most cosmopolitan city and its commercial headquarters, through a network of street cadres.
The Sena?s power grew in the 1970s and 1980s, at the expense of the Communists. Thackeray?s invocation of a proud, native identity especially through the historical figure of Shivaji, a 17th century Hindu Maratha warrior who fought the Muslim Mughals and established a Hindu kingdom, found resonance with disaffected young men at a time of declining industrial jobs. During the ?80s and ?90s, the party members? rough-and-ready tactics gave Thackeray the power to shut down the city.

As of January 2013 Springer will publish the Journal of Arid Land, the official publication of the Xinjiang Institute of Ecology and Geography, part of the Chinese Academy of Sciences (CAS). The quarterly peer-reviewed journal joins Springer?s Chinese Library of Science, a collection of more than 90 high-quality research journals from China. The journal is co-sponsored by the Xinjiang Institute of Ecology and Geography and the CAS. Starting with Volume 5, Issue 1, the Journal of Arid Land will be published jointly by Springer and Science Press.Launched in 2009 and indexed by Science Citation Information Expanded (SCIE) in 2011, the Journal of Arid Land provides a platform for high-quality research papers from all over the world in the fields of geography, geology, pedology, hydrology, biology, ecology and meteorology in arid and semiarid regions. Myanmar announces new prisoner amnesty
YANGON, Myanmar (AP) ? Myanmar's leader has ordered a new prisoner amnesty ahead of a historic visit to the country by President Barack Obama on Monday.
State television said Sunday that President Thein Sein had ordered 66 detainees released, but it was not clear whether any political prisoners would be among them.
A Home Ministry official said that Thein Sein signed the amnesty order Friday, but the prisoners will be freed Monday. The official declined to be named because he is not authorized to speak to the press.
The presidential amnesty was the second announced this week.
On Thursday, Thein Sein announced an amnesty for 452 prisoners, but the move did not include prisoners of conscience and prompted activists to step up calls for the government to release those believed to remain behind bars.
Myanmar's government has long insisted that all prisoners are criminals and does not acknowledge the existence of political detainees. However, the reformist new government, praised for its moves toward democracy, has released hundreds of people this year who were jailed under the former military junta.
A separate press release, issued Sunday, said the government would initiate "initiate a process between the Ministry of Home Affairs and interested parties to devise a transparent mechanism to review remaining prisoner cases of concern by the end of December 2012."
The news came one day ahead of a visit Monday by Obama, who will become the first sitting American president to visit the once-pariah nation, also known as Burma.
Obama is due to meet Thein Sein, as well as opposition leader Aung San Suu Kyi before flying to Cambodia later Monday.
Thein Sein's administration has made freedom for political prisoners one of the centerpieces of its reform agenda. Earlier prisoner releases helped convince Western nations, including the United States, to ease sanctions they had imposed against the previous military regime.
Under the now-defunct junta, rights groups said more than 2,000 activists and government critics were wrongfully imprisoned.
Suu Kyi's party says at least 330 political prisoners remain incarcerated.
Obama said Sunday in Thailand that his visit to Myanmar is an acknowledgement of the democratic transition under way but not an endorsement of the country's government.
Obama's words were aimed at countering critics who say his trip to the country is premature.

Two teens booked with vehicle burglary spree in Barkley Estates ...
Two teenagers have been arrested and booked with burglarizing several unlocked vehicles in the Barkley Estates subdivision of Harvey. Deputies took Tyronne Jones, 17, of 3833 Chinkapin Drive, Harvey, into custody shortly after the burglaries were reported, according to Col. John Fortunato, spokesman for the Jefferson Parish Sheriff's Office.
The second suspect, a 16-year-old Harvey boy, is not being identified because of his age. Six vehicle burglaries were reported to authorities Wednesday morning, three in the 1800 block of Squirewood Drive and three in the 3300 block of the same street.
A victim spotted two men entering his truck around 3:15 a.m. and called 911. Arriving deputies saw the two men dash into a nearby wooded area and set up a perimeter, Fortunato said.
After a search that included help from the K-9 division, deputies found Jones hiding in the woods. They also found a backpack containing a laptop computer, a cell phone case, a pistol, .40-caliber ammunition and a flashlight, Fortunato said.
Jones at first denied any involvement with the burglaries during questioning by detective Kevin Tillman. He told investigators that he was merely in the area to sell marijuana, and it was pure coincidence that he'd run from deputies, Fortunato said.
But Jones eventually admitted to the burglaries, implicating his 16-year-old accomplice and a third teen whose name he did not know. Jones told detectives the trio spent about two hours looting unlocked vehicles before they were caught, Fortunato said.
Tillman prepared a warrant for the 16-year-old suspect on Wednesday, but he wasn't home. Investigators told the boy's parents about the warrant and suggested he turn himself in as soon as possible, Fortunato said. The teen surrendered himself at Rivarde Juvenile Detention Center in Harvey on Thursday.
The case is still under investigation. Detectives are still searching for the third suspect, and Fortunato said investigators believe other items, including global positioning systems, were also taken.

Callers or texters do not have to give their names or testify and can earn a $2,500 reward for information that leads to an indictment.
